Acceptable Use Policy

Applies to everyone

This Acceptable Use Policy ("AUP") governs your use of any service, tool, page, or content provided by Vigilent Technologies LLC ("Vigilent"), including the browser-based Audit Tool, the chatbot, Vigilent Labs, the Client Portal, and the Site itself (collectively, the "Services"). This AUP is incorporated into and part of the Terms of Service. Violating it may result in suspension or termination of your access, referral to law enforcement, or legal action.

Rights and permissions you must have

• Only scan code you have the right to scan. Do not upload source code, configuration, or other content into the Audit Tool unless you own it or have obtained explicit written permission from the rights holder to analyze it.
• Do not use the Services to reverse engineer, disassemble, or decompile software in violation of applicable law, license, or contractual restrictions.
• Do not use the Services to scan code belonging to a competitor or third party for the purpose of extracting trade secrets or bypassing licensing.

Prohibited activities

You may not use the Services to:

• Violate any applicable law, regulation, or third-party right;
• Distribute, upload, or generate malware, ransomware, spyware, or other malicious code;
• Attempt to gain unauthorized access to any system, network, account, or data;
• Interfere with, disrupt, or degrade the Services, our infrastructure, or other users' access — including by denial-of-service attacks, high-volume automated requests, or excessive scraping;
• Circumvent, disable, or attempt to bypass any security feature, rate limit, or access control;
• Reverse engineer, extract, or replicate the Audit Tool's rule sets, framework mappings, or scoring logic for the purpose of building a competing product;
• Impersonate Vigilent, another user, or any other person or entity;
• Use the Services to generate misleading compliance, audit, or certification claims about your organization or another party;
• Resell, sublicense, or provide the Services to third parties without a separate written agreement with Vigilent;
• Use automated means (bots, crawlers, scripts) to access the Services except as expressly permitted;
• Upload personal information about others without a lawful basis;
• Use the Services in a way that could harm minors.

Fair use of the Audit Tool

The Audit Tool is an internal instrument used by Vigilent staff to deliver Code Assessment engagements; it is not offered as a free or self-service public product. Any output shared with a customer is provided solely as part of a scoped engagement. Reverse engineering, extracting, or replicating the tool's rule sets, framework mappings, or scoring logic, or attempting to access it outside an authorized staff session, is prohibited.

Reporting violations

If you become aware of a violation of this AUP or believe the Services have been misused, please report it to mroberson@vigilenttechnologies.com. We take reports seriously and will investigate.

Enforcement

Vigilent may investigate suspected violations of this AUP and take any action we consider appropriate, including warning you, suspending or terminating your access, deleting content, cooperating with law enforcement, and pursuing legal remedies. Vigilent's decisions about enforcement are made at our sole discretion.

Changes to this AUP

We may update this AUP from time to time. Material changes will be posted with a new Effective date and, where feasible, noticed through the Services.
